Parlin Memorial Library

Eversource &amp; National Grid invite members of the Boston and Everett communities to attend a series of in-person events to discuss a jointly proposed underground electric transmission cable replacement project along Broadway Street (Everett) and Alford Street (Boston-Charlestown). The proposal is part of a larger program Eversource is conducting throughout its service territory in Massachusetts related to underground cable modernization. This initiative is designed to modernize cable infrastructure, improve outage restoration times, and ensure long-term energy reliability by replacing existing underground fluid filled (HPFF) electric transmission lines with cross-linked polyethylene (XLPE) electric transmission cable technology. Information about the project is available in Spanish, Portuguese, Haitian Creole, and other languages upon request. Eversource &amp; National Grid’s series of events are as follows:

Wills
A will is a legal document that specifies asset distribution after death. For instance, an elderly person may assign her home to her daughter and divide her investments among her grandchildren. Wills undergo probate, a potentially lengthy and costly public process where a court validates the will and ensures all debts and taxes are paid.
Revocable Trusts
Revocable trusts, or living trusts, provide flexibility, allowing control over assets during one's lifetime with the ability to alter or dissolve the trust before death. For example, a retired couple might manage their assets—like their home and savings—through a revocable trust, ensuring these bypass probate and quickly reach beneficiaries after their death. This setup offers significant tax advantages, including estate tax minimization.
Tax Saving Benefits for Married Couples in Massachusetts
In Massachusetts, where estates exceeding a $2 million threshold face heavy taxes, revocable trusts are particularly beneficial for married couples. By creating separate trusts, couples can protect up to $4 million from estate taxes, with each spouse allocating up to $2 million to their trust. This setup prevents the immediate taxation of the deceased’s estate, supports the surviving spouse, and maintains asset management and protection.
Irrevocable Trusts for the Ultra-Wealthy
Irrevocable trusts suit ultra-wealthy individuals managing large estates. Unlike revocable trusts, they cannot be altered once established. These trusts keep transferred assets out of the taxable estate, significantly reducing estate taxes and protecting assets from creditors.
Life Insurance and Irrevocable Trusts (Beyond the Living Trust)
An irrevocable life insurance trust (ILIT) is strategic for estates above the Massachusetts tax exemption, purchasing life insurance that pays out to the trust, thus not adding to the taxable estate. This protects the proceeds from estate taxes. This approach is usually a second step after a revocable trust is employed as step one in the overall estate plan.
Existing Policies
Transferring existing life insurance policies to an ILIT can also reduce estate taxes, provided the transfer occurs more than three years before the death of the insured to avoid inclusion in the taxable estate.
Comparison and Considerations
Choosing between wills, revocable trusts, and irrevocable trusts depends on personal needs, estate size, and control preferences. Wills are simple but involve probate, while revocable trusts offer flexibility and privacy. Irrevocable trusts provide tax and asset protection but require relinquishing control. Each option should be considered with the help of an experienced estate planning attorney to ensure financial goals are met and estate distribution aligns with the individual's wishes.
